End User License Agreement

This End User License Agreement (“EULA”) is a contract between you and Individual Entrepreneur Artem Tarasov, registration № 72930421, 002, 5 Deghatan str., Yerevan, Republic of Armenia (“Kismet,” “we,” “us”) for use of the Kismet plugin for Unreal Engine (the “Plugin”). By installing, copying, or using the Plugin you accept this EULA. If you do not accept it, do not install or use the Plugin.

This EULA supplements — and is incorporated into — the Kismet Terms of Service (“Terms”). Capitalised terms not defined here have the meanings given in the Terms. If anything in this EULA conflicts with the Terms, the Terms control.

1.Beta status

The Plugin is currently in beta. It is provided for evaluation, may be unstable or incomplete, and may be changed, suspended, or discontinued at any time. Keep your work under source control and back up your project before letting the Plugin act on it.

2.Account requirement

The Plugin requires a Kismet account. You authenticate the Plugin through a device-code flow at kismetai.io. The Plugin will not run agent operations until your account is linked.

3.License grant

Subject to your continuing compliance with this EULA and the Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the Plugin internally with Unreal Engine for as long as you have an active Kismet account. The licence is per-user; do not share your account or Plugin token.

The Plugin is licensed, not sold. We retain all right, title, and interest in the Plugin. No rights are granted to you by implication, estoppel, or otherwise.

4.Restrictions

You will not, and will not let anyone else:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Plugin, except to the extent applicable law expressly permits despite this restriction.
  • Remove, alter, or obscure any copyright, trademark, license, or other proprietary notices.
  • Resell, sublicense, rent, lease, or commercially redistribute the Plugin, your Kismet account, or your Plugin token.
  • Use the Plugin or its outputs to train, fine-tune, distil, or benchmark a competing AI product, model, or feature.
  • Use the Plugin to generate or assist with code you do not have the rights to use, or in violation of any law or third-party right.
  • Bypass authentication, telemetry redaction, rate limits, or other protective mechanisms.

The full acceptable-use list is in our Acceptable Use Policy (also incorporated into §5 of the Terms), and applies here. It mirrors Anthropic’s Usage Policy because the Plugin calls Claude under your own API key.

5.Bring your own key (BYOK)

The Plugin calls a third-party AI provider (currently Anthropic) directly from your machine using an API key you provide. Your relationship with that provider is governed by their terms and privacy policy. We are not a party to that relationship and have no contract or payment relationship with the provider on your behalf. You are responsible for all charges your provider invoices you for. Your API key is stored locally in your operating-system credential store and is never transmitted to or proxied through Kismet servers.

6.AI-generated suggestions

The Plugin’s agent loop generates Blueprint nodes, edits, code, explanations, and other outputs (“Suggestions”). Suggestions are produced by a probabilistic AI model. They may be wrong, incomplete, contain bugs, mis-cite documentation, or reflect biases in the model’s training data.

Factual assertions in Suggestions should not be relied upon without independently verifying their accuracy, as they may be false, incomplete, misleading, or not reflective of recent events. Suggestions may contain content that does not reflect the views of Anthropic or of Kismet.

You are solely responsible for reviewing every Suggestion before relying on it, and for the impact of any change the Plugin makes on your machine — including data loss, broken builds, or corrupted assets.

We claim no ownership of Suggestions. To the extent we have any rights in a Suggestion as delivered to you, we assign those rights to you, free of charge, and keep no licence to them.

6.1 High-risk use cases

If you use a Suggestion to inform a consumer-facing decision in a high-risk domain — including legal advice, medical or mental-health care, insurance underwriting, financial or credit decisions, employment or housing decisions, academic scoring or admissions, or journalism intended for external publication — you must (a) keep a qualified human in the loop and (b) clearly disclose AI involvement to the affected end-users. This obligation comes from the AI provider’s Usage Policy and is reproduced in our Acceptable Use Policy §3. Kismet itself is a developer tool and is not licensed for these scenarios; if you build a downstream product that is, the obligation sits with you as that product’s operator.

7.Telemetry

The Plugin sends usage telemetry to your Kismet account. Telemetry is split into four categories — Runs, Tool calls, Errors, Crashes — that you control independently in Settings → Telemetry. With all four off, only essential heartbeat events flow. Blueprint contents are redacted at our ingestion endpoint before storage. For implementation details see Data & Security.

8.Auto-update

The Plugin checks our release manifest at start-up to discover newer versions. The check sends only your Plugin version, OS family, Unreal Engine version, and machine ID. Update download and installation are user-initiated; we do not silently push code to your machine. You can disable update checks in the Plugin settings.

9.Open-source and third-party components

The Plugin links against Unreal Engine modules provided by Epic Games, Inc. and may include other third-party components. Attribution and licence notices for those components are in the NOTICE.md file shipped with the Plugin. Your use of Unreal Engine itself is governed by Epic’s Unreal Engine End User License Agreement, separate from this EULA.

Kismet is an independent product. It is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. Unreal Engine and Blueprint are trademarks of Epic Games, Inc.; their use here is descriptive.

10.Term and termination

This EULA takes effect when you first install or use the Plugin and continues until terminated. You may terminate it at any time by uninstalling the Plugin and requesting account deletion from your dashboard. We may suspend or terminate it for material breach of this EULA or the Terms, to comply with law, or if the Plugin is discontinued.

On termination: your licence ends immediately, you must stop using and uninstall the Plugin, and the data-deletion schedule in §10 of the Privacy Policy applies. Sections 4, 6, 11, 12, 13, 14, and 15 survive.

11.Disclaimer of warranties

The Plugin and all Suggestions are provided “as is” and “as available,” without warranty of any kind, express or implied. To the maximum extent permitted by law we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Plugin will be uninterrupted, error-free, or secure, or that Suggestions will be correct, complete, or fit for any purpose. Some jurisdictions don’t allow exclusion of certain implied warranties; to that extent the exclusions in this section may not apply to you.

12.Limitation of liability

To the maximum extent permitted by law, in no event will Kismet be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of goodwill, even if advised of the possibility.

Our aggregate liability for all claims relating to the Plugin in any twelve-month period is limited to the greater of (a) the fees you paid us during that period (currently zero) or (b) one hundred United States dollars (US$100). These limits are an essential part of the bargain.

13.Export controls and sanctions

You will comply with applicable export-control and sanctions laws. You confirm that you are not located in, under the control of, or a national or resident of, a country or territory subject to a comprehensive embargo by Armenia, the United States, the European Union, or the United Kingdom; and that you are not on any restricted-party list maintained by those jurisdictions.

14.Governing law and disputes

This EULA is governed by the laws of the Republic of Armenia, without regard to conflict-of-laws principles. The courts of Yerevan, Republic of Armenia have exclusive jurisdiction, subject to a 60-day informal-resolution period and to mandatory consumer-protection rights you may have in your home jurisdiction (see §16 of the Terms).

15.Miscellaneous

  • Entire agreement.This EULA, together with the Terms, Privacy Policy, and Data & Security page, is the entire agreement between you and us about the Plugin.
  • Severability. If any provision is unenforceable, the rest stays in effect.
  • Assignment. You may not assign this EULA without our written consent. We may assign it to an affiliate, successor, or acquirer.
  • No waiver. Our failure to enforce a right is not a waiver of it.
  • Updates to this EULA. We may update this EULA when our practices change. The effective date at the top reflects the last change. Material changes will be announced at least 14 days before they take effect; continued use after that means you accept the updated EULA.
