Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kismet — the Plugin for Unreal Engine and the website at kismetai.io and its dashboards (collectively, the “Service”). By installing the Plugin or creating an account you agree to these Terms. If you don’t agree, don’t use the Service.

Kismet is operated by Individual Entrepreneur Artem Tarasov, registration № 72930421, 002, 5 Deghatan str., Yerevan, Republic of Armenia (“Kismet,” “we,” “us”). Contact: legal@kismetai.io.

How we handle your data is described separately in our Privacy Policy and Data & Security page.

1.Beta status

The Service is currently in beta. It is provided for evaluation purposes, may be unstable or incomplete, and may be changed, suspended, or discontinued in whole or in part at any time. You should not rely on the Service for production work without your own backups and version control.

2.Eligibility and accounts

You must be at least 18 years old and legally able to enter into this contract. You may not use the Service if a prior account of yours has been suspended or terminated for cause.

You are responsible for maintaining the confidentiality of your account credentials and Plugin tokens, and for all activity under your account. Notify us at legal@kismetai.io if you believe your account has been compromised.

3.Independent product disclaimer

Kismet is an independent product. It is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. Unreal Engine and Blueprint are trademarks of Epic Games, Inc.; their use here is purely descriptive (to refer to the engine the Plugin works with).

4.The agent and AI providers

4.1 Bring your own key (BYOK)

The Plugin calls a third-party AI provider (currently Anthropic) directly from your machine using an API key you provide. Your relationship with that provider is governed by their terms and privacy policy. Kismet is not a party to that relationship and has no contract or payment relationship with the AI provider on your behalf. You are responsible for all charges your provider invoices you for.

4.2 Suggestions are unverified

The agent generates Blueprint nodes, edits, code, explanations, and other outputs (“Suggestions”). Suggestions are produced by a probabilistic AI model. They may be wrong, incomplete, contain bugs, mis-cite documentation, or reflect biases in the model’s training data. You are responsible for reviewing every Suggestion before relying on it.

4.3 Autonomous editing of your project

The Plugin acts on your Unreal project files at your direction. It can write, modify, and delete Blueprint nodes; reorganise graphs; trigger compilation; and otherwise change the state of your project. You are solely responsible for the impact of those changes, including data loss, broken builds, or corrupted assets. Use source control. Keep backups. We are not liable for losses caused by changes the agent made on your machine.

4.4 No model training on your content

We do not train, fine-tune, or evaluate AI models on your prompts, the assistant’s replies, or your telemetry, and we do not allow third parties to do so. The narrow exceptions (explicit feedback, security review, opt-in) are described in §6 of the Privacy Policy.

5.Acceptable use

5.1 Kismet-specific restrictions

You will not:

  • Use the Service to generate, distribute, or assist with code that you obtained illegally or that you do not have the rights to use (for example, code copied from a leaked or unlawfully accessed source tree, or code that infringes someone else’s intellectual-property or contractual rights).
  • Reverse engineer, decompile, or disassemble the Service or Plugin, except to the extent that applicable law expressly permits despite this restriction.
  • Use the Service or any output to train, fine-tune, distil, or benchmark a competing AI product, model, or feature.
  • Resell, sublicense, rent, or commercially redistribute the Plugin, your account, or your Plugin tokens.
  • Submit data subject to special legal regimes (e.g., HIPAA- protected health information, PCI-regulated payment card data, GLBA-protected financial data, classified-government data, or children’s personal data) — the Service is not designed or contracted to receive such data.
  • Probe, scan, or test the vulnerability of the Service except under a coordinated disclosure to legal@kismetai.io.
  • Attempt to bypass authentication, rate limits, abuse-prevention mechanisms, or telemetry-redaction logic; scrape the Service; or use automated agents to mass-create accounts.
  • Use the Service to violate any law, infringe anyone’s rights, or generate content that is unlawful in your jurisdiction or in Armenia.

5.2 Anthropic Usage Policy (incorporated)

Because Kismet uses Anthropic’s Claude as its AI provider and you supply your own API key, Anthropic’s Usage Policy binds you directly. We mirror its restrictions in our Acceptable Use Policy so the rules are visible in one place; the AUP is incorporated into these Terms by reference. In short, you may not use the Service for CSAM or any sexualisation of minors, weapons development (including CBRN), attacks on critical infrastructure, unauthorised computer or network compromise, malware, violent extremism or terrorism, hateful or harassing content, non-consensual privacy violations or impersonation, self-harm promotion, election interference or deceptive political content, surveillance or social-scoring decisions without meaningful human review, fraud, phishing, spam, or sexually explicit content. The full list — including high-risk-use-case obligations for legal, medical, financial, employment, housing, academic, and journalistic outputs — is on the AUP page.

We may suspend or terminate access for material or repeated violations of these rules. We will report unlawful content (in particular CSAM) to the appropriate authorities.

6.Your content

6.1 What “Your Content” means

“Your Content” means: prompts you send to the agent, the Blueprint and project files the Plugin reads on your machine, bug reports and feedback you submit, and account metadata you provide. Your Content stays yours.

6.2 Suggestions belong to you

We claim no ownership of Suggestions the agent produces in response to Your Content. To the extent we have any rights in a Suggestion as delivered to you, we assign those rights to you, free of charge, and we keep no licence to it. You should still verify that the Suggestion does not include third-party material that requires attribution or licensing on your end.

6.3 Limited licence to operate the Service

You grant Kismet a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display, and process Your Content solely as needed to operate the Service for you and to do the things described in §5 of the Privacy Policy (debug, support, abuse prevention, legal compliance). This licence ends when you delete the relevant content or your account, subject to the backup/log retention windows described there.

6.4 Feedback

If you send us suggestions, ideas, or feedback about the Service, we may use them without restriction or compensation to improve the Service. You confirm you own the rights you need to give us that licence.

6.5 Warranty about Your Content

You confirm you have the rights you need to send us Your Content and that doing so does not violate any law or third-party right.

No secrets, no third-party personal data, no NDA material. You will not paste into prompts, tool inputs, bug reports, or any other field that the Plugin or Site transmits to us: third-party API keys (including your Anthropic key), passwords, OAuth tokens, session cookies, SSH or signing keys, personal data of identifiable third parties, or material covered by a non-disclosure obligation you owe to anyone else. The Plugin applies automated redaction to Blueprint contents and to common credential patterns as described in the Privacy Policy, but those filters are best-effort and do not relieve you of this obligation. You acknowledge that anything you do submit will be processed and stored as described in the Privacy Policy, and that you are responsible for any harm caused by submitting prohibited material, including the cost of rotating any credentials that you exposed.

7.Plugin licence

The Plugin is provided to you under a limited, revocable, non-exclusive, non-transferable licence to install and use it internally with Unreal Engine for as long as you have an active Kismet account and comply with these Terms. The Plugin is proprietary software; you do not get any source-code rights and no rights other than the use right described in this section. All rights not expressly granted are reserved.

8.Pricing and payment

The Service is currently free of charge. You are responsible for AI-provider fees billed to you directly by your provider (see §4.1).

We reserve the right to introduce paid tiers. If we do, we will publish the pricing and the supplemental payment terms before they take effect, and any new charge will require your affirmative consent. Because the current Service is free, no refunds are available; any future paid offering will state its own refund and cancellation rules.

9.Suspension and termination

You can stop using the Service at any time and request account deletion from your dashboard. We may suspend or terminate your access:

  • For material breach of these Terms, including §5;
  • To protect the Service, our users, or third parties from a security or abuse risk;
  • To comply with a legal obligation;
  • If the Service or a portion of it is discontinued.

On termination, your licence to the Plugin ends and we will delete your account data on the schedule described in §10 of the Privacy Policy. Sections that should naturally survive termination (ownership, disclaimers, liability, indemnity, dispute resolution) survive.

10.Disclaimers

The service and all suggestions are provided “as is” and “as available,” without warranty of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that Suggestions will be correct, complete, or fit for any purpose.

Some jurisdictions don’t allow exclusion of certain implied warranties; to that extent the exclusions in this section may not apply to you.

11.Limitation of liability

To the maximum extent permitted by law, in no event will Kismet (or its sole proprietor, agents, or licensors) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of goodwill, even if advised of the possibility.

Our aggregate liability for all claims relating to the Service in any twelve-month period is limited to the greater of (a) the fees you paid us during that period (currently zero) or (b) one hundred United States dollars (US$100).

These limits are an essential part of the bargain and apply regardless of the legal theory of the claim. Some jurisdictions don’t allow these limitations; to that extent they apply only to the extent permitted.

12.Indemnity

You will defend, indemnify, and hold harmless Kismet from claims, damages, and reasonable costs (including legal fees) arising from (a) your breach of these Terms, (b) your use of the Service in violation of law or third-party rights, including any claim that Your Content infringes someone else’s rights, or (c) any Suggestion you used in your project that turned out to expose you, your employer, or your client to liability. We will tell you about any claim promptly and let you control the defence, provided you do not settle in a way that affects our rights without our consent.

13.Trademarks

“Kismet” and the Kismet logo are our marks. Unreal Engine and Blueprint are trademarks of Epic Games, Inc.; we use them descriptively only and claim no rights in them.

14.Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to legal@kismetai.io with subject “copyright”. Include: identification of the copyrighted work, the URL or location of the allegedly infringing material, your contact details, a good-faith statement that the use is not authorised, a statement under penalty of perjury that your notice is accurate and that you are authorised to act, and your physical or electronic signature.

15.Changes to the Service or Terms

We may modify the Service at any time, including adding, changing, or removing features. We may update these Terms; the effective date at the top of the page reflects the last change. Material changes will be announced in the dashboard or by email at least 14 days before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms; if you don’t accept them, stop using the Service and request account deletion before the effective date.

16.Governing law and disputes

16.1 Informal resolution first

We’d much rather resolve disagreements directly. If you have a complaint, write to legal@kismetai.io with the details. You agree to attempt to resolve any dispute informally for at least 60 days after first notice before starting formal proceedings.

16.2 Governing law

These Terms and any non-contractual obligations connected with them are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws principles.

16.3 Jurisdiction

Subject to §16.1, the courts of Yerevan, Republic of Armenia have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. We and you each consent to the personal jurisdiction of those courts.

16.4 Consumer rights

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws give you the right to sue in your home courts and have your local law applied to that lawsuit, nothing in §16.2 or §16.3 takes those rights away.

17.Export controls and sanctions

You will comply with applicable export-control and sanctions laws. You confirm that you are not located in, under the control of, or a national or resident of, a country or territory subject to a comprehensive embargo by Armenia, the United States, the European Union, or the United Kingdom; and that you are not on any restricted-party list maintained by those jurisdictions.

18.Miscellaneous

  • Entire agreement.These Terms, together with the Privacy Policy and Data & Security page, are the entire agreement between you and us about the Service and supersede any prior agreements.
  • Severability. If any provision is held unenforceable, the rest stays in effect and the unenforceable part is replaced with an enforceable equivalent that comes closest to the original intent.
  • No waiver. Our failure to enforce a right is not a waiver of that right.
  • Assignment.You can’t assign these Terms without our written consent. We can assign them to an affiliate, successor, or acquirer of the Service.
  • Notices to you may be given by email to the address on your account or by posting in the dashboard. Notices to us go to legal@kismetai.io.
  • No support obligation. While the Service is in beta, we do not commit to any service level or support response time.
  • Force majeure. Neither side is liable for failure to perform caused by events beyond reasonable control.
Plain-English summary (not a substitute for the Terms above): the Service is in beta and free; you bring your own AI-provider key; the agent edits your project — back things up; outputs belong to you; we don’t train models on your data; if there’s a dispute we’ll try to talk it out, otherwise it goes to court in Yerevan under Armenian law; consumer-law rights aren’t affected.
